Abstract

Pemakaian al-Istihalah dalam penetapan makanan dan barangan halal semasa masih diperbahaskan. Ini kerana terdapat pandangan yang berbeza di kalangan fuqaha’ dalam penerimaannya sebagai kaedah pertukaran status barangan daripada najis kepada suci. Perbezaan pandangan tersebut boleh dibahagikan kepada dua iaitu golongan yang menyempitkan skop pemakaiannya (Shafi’iyyah) dan golongan yang memperluaskan (Hanafiyyah). Sehubungan dengan itu, tulisan ini dikemukakan untuk membincangkan kedudukannya dalam penetapan halal semasa berdasarkan ukuran Maqasid al-Shariah. Analisis terhadap pandangan para fuqaha’ daripada kedua-dua golongan, dapatan kajian-kajian semasa dan situasi industri halal semasa dibuat bagi melihat kesesuaian pemakaiannya bagi mencapai maslahah dan menolak mafsadah. Analisis menunjukkan bahawa pemakaian al-Istihalah berdasarkan pendapat golongan yang menyempitkan skopnya lebih menepati Maqasid al-Shariah dalam situasi industri halal semasa tanpa menafikan ruang untuk pemakaian golongan yang memperluaskannya apabila ada keperluan dan menepati konsep al-Istihalah yang dipersetujui iaitu berlakunya perubahan secara keseluruhan. Kata kunci: Maqasid al-Shariah, Halal, Istihalah, Maslahah ABSTRACT Muslim scholars differ on the function of al-Istihalah in deciding cleanliness of filthy (najs) materials transformed to another thing. These differences can be divided into two groups; those who only apply it on very limited things based on permissibility mentioned in al-Quran or Sunnah (Shafi’iyyah), and those who extend the application to other materials based on qiyas (Hanafiyyah). Hence, this article is proposed to discuss the function of al-Istihalah in deciding halalness of certain materials in current halal industry from the perspective of Maqasid al-Shariah. The discussion focuses on analyzing opinions of scholars from both groups, contemporary research on the area of discussion and situation of current halal industry as well. The analysis is based on the intellectual discourse using established methods to determine Maqasid al-Shari’ah. From the analysis, it is concluded that the application of al-Istihalah in the current halal industry according to opinion of Shafi’iyyah is more favourable with Maqasid al-Shariah without denying the application of it in more extended things based on qiyas (Hanafiyyah) if it is needed and met with the agreed concept of al-Istihalah which is total transformation.
